Rental waiver template

This agreement covers the equipment I rent from [Your business] and my use of it.

The equipment

• I have inspected the equipment and it is in good working order. I will report any problem before I leave.
• I will use it only as intended, within the area and times staff explain, and I will not lend it to anyone else.
• I will wear the helmet or life jacket provided, and make sure any minors in my group do too.
• I will return the equipment on time and in the same condition. I am responsible for loss, theft or damage beyond normal wear.
• I will not use the equipment under the influence of alcohol or drugs.

Assumption of risk

I understand that cycling, paddling and the use of rental equipment on roads, trails and water, including weather, traffic, cold water and drowning involves risks, including the risk of serious injury, permanent disability and death, and damage to or loss of property. I choose to take part voluntarily and I accept these risks, whether they are known or unknown.

Release of liability

To the fullest extent allowed by law, I release, waive and discharge [Your business], its owners, employees, instructors, contractors and agents (together, "the Released Parties") from any and all claims, demands or causes of action arising from my participation, including those caused by the ordinary negligence of the Released Parties.

Indemnity

I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage or cost, including legal fees, that arises from my participation or my conduct.

Medical treatment

I confirm that I am in good health and have no condition that makes it unsafe for me to take part. If I am injured or become ill, I authorize [Your business] to arrange first aid or emergency medical treatment, and I agree to pay any costs.

Photos

I agree that [Your business] may take photos or video during activities and use them to promote its services, unless I tell staff that I do not agree.

General

This agreement is governed by the laws of the place where [Your business] operates. If any part of it is found to be invalid, the rest stays in force. I have read this agreement, I understand it, and I am signing it voluntarily. I understand that I am giving up substantial legal rights by signing.

Minors

If I am signing for a child under 18, I confirm that I am their parent or legal guardian, that I agree to these terms on their behalf and on my own, and that I have explained the rules and risks to them.
